DSCLZR.US TERMS OF SERVICE AND END USER LICENSE AGREEMENT
Dsclzr.us is a service provided by The New Rules, LLC (referred to herein as "us" and "we"). By using this service we hope that you will feel more at ease with requesting and making endorsements of goods and services on your blog or in other forms of social media you use. By using this service, you agree to be bound by these Terms of Service and End User License Agreement ("Agreement"). If you don't agree to everything that is on this page, you are not authorized to use the dsclzr.us Service (as that term is defined below), and we kindly ask that you point your browser elsewhere.
1. Dsclzr.us is a service we provide whereby you can designate content you published as covered by certain disclosures that may be required by the United States Federal Trade Commission or other law enforcement agencies (the "Service"). If you feel that you are endorsing a product (i.e., a particular good or service), then you may wish to use the Service to disclose to your readers or followers any "material connection" you have with the entity advertising the product.
2. We are merely the provider of a service you can use as you wish. We do not independently verify the claims you make about the material connections you may have with an advertiser and therefore cannot be responsible if you do not correctly disclose the nature of the endorsement you are making. Federal law would protect us from liability for your use of the service (since you are the one providing the information) but we figured we would do you the favor of reminding you of that fact anyway. So exercise good sense when you are using dsclzr.us.
3. We grant you a limited, nonexclusive, revocable, royalty free license to access and use the software solely to designate the nature of any material connection you may have with the advertiser providing the product or products you endorse. This license is granted to you on the condition that you comply with all the terms of this Agreement. Any use not in accordance with these terms is unlicensed and not authorized. We reserve all rights not expressly granted to you by this Agreement.
4. We reserve the right to discontinue the Service, or terminate your use of the Service at any time and for any reason without prior notice to you. You remain responsible at all times for ensuring that your disclosures are correct and up to date.
5. We are providing you the Service "as-is" without any warranties that it will always be available, that it will be error-free, or that it will be fit for your particular purpose. WE DISCLAIM ALL WARRANTIES, EXPRESS AND IMPLIED.
6. You agree to defend, indemnify and hold us harmless for any claims brought against us by any third party (including any governmental body or agency) arising from or in connection with your use of the Service.
7. This Agreement shall be governed by the laws of the state of New Jersey, and the exclusive forum and venue for any dispute arising from or in connection with your use of the Service shall be any court situated within the Northern District of New Jersey.
8. You agree that you will not use the Service for any illegal or improper purpose such as harassing others, distributing unsolicited electronic communications or distributing viruses or other similar malicious computer code.
9. You agree to be bound by the dsclzr.us Privacy Policy which is hereby incorporated by reference. The Privacy Policy governs, among other things, the type of information we collect from you and how we use that information. You agree that all information you provide to us will be accurate and that you will keep that information up to date.
10. This Agreement was last modified on December 1, 2009. We reserve the right to modify the terms of this Agreement at any time and your continued use of the Service will constitute your acceptance of those changes. In the event there are significant changes to be made, we will endeavor to notify you of those changes via the email address for you that you provide in the sign up process.
